Same-sex couples in New Mexico facing divorce will now navigate custody disputes under new guidelines. The New Mexico Supreme Court has ruled that legal custody decisions should prioritize the best interests of the child.

This decision stems from a 2017 case involving Jeannine Kammann, who had been denied legal parent status because her children did not share her genes. Kammann’s ex-wife had given birth to their children through artificial insemination during their marriage.

In a significant ruling, the court decided in favor of Kammann, affirming that she should be recognized as a legal parent regardless of genetic ties.
