Man Sentenced for Providing Weapon Used in Alamogordo Officer’s Death
An Alamogordo man has been sentenced to federal prison for providing a modified shotgun that was used in the 2023 killing of Alamogordo Police Officer Anthony Ferguson.
According to court documents, 31-year-old Jonah Apodaca supplied a “sawed-off” shotgun to Dominic Cruz De La O, who is accused of later using the weapon to fatally shoot Officer Ferguson. Investigators discovered Apodaca’s DNA on a shotgun shell found in the chamber of the weapon, along with additional ammunition in the magazine tube.
In June 2024, Apodaca pleaded guilty in federal court to charges related to possessing the unregistered firearm. He was recently sentenced to 72 months in prison, followed by three years of supervised release upon completion of his sentence.
Dominic Cruz De La O faces charges of possessing a firearm that was not registered with the National Firearm Registration and Transfer Record, as well as possessing a firearm without a serial number. He remains in custody as he awaits trial, which is scheduled to begin on February 26, 2025.
Officer Anthony Ferguson, 41, was an 11-year veteran of the Alamogordo Police Department, serving in the Patrol Division as a Field Training Officer.
