COINING IT: Americans to get check up to $7.5k in line with $18.5m data breach settlement – all you need is bank statement

According to The Sun, Americans could be eligible for a portion of an $18.5 million settlement after East River Medical Imaging was targeted by hackers. However, the deadline to apply is fast approaching.

The medical provider is involved in a class action lawsuit in New York stemming from a data breach that occurred between August and September 2023. During this breach, personal patient information was accessed, leading class members to accuse East River Medical of failing to adequately protect their private data. The lawsuit alleges that sensitive information stolen included insurance details, social security numbers, contact information, and even procedure information and imaging results.

The complaint asserts that the radiology center could have prevented the breach by implementing stronger digital security measures. While East River Medical has not admitted any wrongdoing, the company has agreed to settle the claims to end the ongoing litigation.

Compensation Details

Individuals whose data was compromised in the breach, as well as those who received a data breach notification, are eligible to apply for compensation. Claimants can choose between two compensation options:

  1. Expense Reimbursement: Eligible claimants can receive up to $7,500 for losses related to the breach, including bank fees, damages due to fraud or identity theft, and costs incurred from hiring professional services. To claim this compensation, class members must provide proof of their losses, such as bank statements, receipts, invoices, or other documentation reflecting expenses related to the breach.
  2. Pro Rata Cash Payment: For those without proof of losses or who prefer not to claim reimbursement, a pro rata cash payment option is available. This amount will be distributed from the remaining settlement fund after all claims have been processed.

In addition to these payments, all claimants will receive one year of access to three-bureau credit monitoring to help detect potential fraud.

Important Deadlines

Time is running out to file a claim, with the portal for submitting valid claim forms set to close on October 22. Class members had until August 23 to exclude themselves from the settlement or object to the terms. If claimants miss the deadline to apply for the settlement fund, they will forfeit any cash or credit monitoring benefits.

Those who successfully excluded themselves retain the right to pursue legal action against the radiology center in the future regarding the same claims, should they choose to do so.

All valid claims can be submitted on the settlement website provided in the notification.
