BIG WIN: Americans in line for one-time payment from $920,000 wage settlement pot – no form is required to get cash

According to THE SUN, Americans who worked for AOCLSC, an American oil company, may be eligible for cash payments from a $920,000 settlement. This settlement addresses allegations that AOCLSC failed to pay its workers their due wages under California law.

Settlement Details

The class action lawsuit claims that AOCLSC did not provide proper compensation, including hourly, minimum, and overtime wages, nor did it offer required meal and rest periods or accurate wage statements.

Employees who worked in non-exempt hourly positions in California between May 8, 2019, and May 15, 2023, could receive a payment. Additionally, the settlement includes a Private Attorneys General Act (PAGA) class for employees working between June 1, 2021, and May 15, 2023.

While AOCLSC, the parent company of AOCUSA (formerly known as Amalie Oil Company), has not admitted to any wrongdoing, it agreed to the settlement to resolve the lawsuit. Payments to class members will be based on the number of workweeks and PAGA pay periods worked during the class period.

Deadlines

Class members do not need to file a claim form but have until September 9, 2024, to challenge the number of workweeks allotted to them from the settlement. The deadline for excluding oneself or filing an objection is October 9, 2024. Note that opting out of the PAGA portion of the settlement is not permitted.

The final approval hearing for the AOCLSC settlement is set for November 8, 2024.

Other Settlements Across the US

In addition to the AOCLSC settlement, several other notable class action settlements are currently in progress:

  • Tax Act Privacy Settlement: Individuals who used the Tax Act online tax filing service may be entitled to a share of a $14.95 million settlement. The lawsuit alleges that the service mishandled user privacy by sharing information with third parties like Meta and Google.
  • TD Bank Overdraft Fees: TD Bank customers may be eligible for compensation from a $32.335 million settlement over alleged illegal overdraft fees charged between June 27, 2019, and September 30, 2022.
  • Canned Tuna Price Fixing: Shoppers who purchased cans of tuna from StarKist and Lion Capital between June 1, 2011, and December 31, 2016, might receive a portion of a $3.875 million settlement. The companies are accused of conspiring to fix prices on Foodservice-Size packaged tuna products of 40 ounces or more. Customers of Sam’s Club and Costco who bought these products may also qualify for compensation.
