
According to The Sun, An international law firm, Orrick, Herrington & Sutcliffe, has agreed to pay $8 million to settle claims arising from a significant data breach that allegedly compromised client information. The firm will provide payments of up to $10,000 to affected individuals, contingent on their submission of valid receipts.
Details of the Data Breach Settlement
The settlement follows a class action lawsuit where plaintiffs claimed that hackers accessed their sensitive information through unauthorized file transfers, which they argue was due to Orrick’s negligence. The lawsuit contends that the firm failed to implement adequate cybersecurity measures to safeguard client data.
While Orrick did not admit any wrongdoing, the settlement allows class members to claim cash benefits, which may include reimbursement for lost time, expenses related to the data breach, and compensation under California law.
Compensation Structure
Under the terms of the settlement, individuals can receive:
- Up to five hours of lost time reimbursement at a rate of $25 per hour, totaling a potential $125.
- Up to $2,500 for ordinary expenses incurred as a result of the data breach, such as costs related to identity theft or fraud, with total reimbursements potentially reaching $7,500.
- The maximum payment per individual is capped at $10,000.
For those who prefer a simpler option, class members can opt for a $75 cash payment instead of pursuing the reimbursement claims.
Additionally, California residents can claim an extra $150 under the state’s Consumer Privacy Act.
Additional Benefits for Class Members
All class members are eligible for three years of complimentary three-bureau credit monitoring and identity theft protection services. This benefit aims to assist individuals in protecting their identities in the aftermath of the breach.
The class action specifically benefits individuals who received a data breach notification from Orrick between March 2023 and December 2023. To receive settlement benefits, affected individuals must submit a valid claim form by October 28.
Important Dates and Documentation
The final approval hearing for the settlement is scheduled for November 8. To secure cash benefits, class members must provide proof of purchase, which can include account statements, phone or internet bills, tax returns, and other relevant documents.
